This Privacy Policy does not override the terms of an applicable signed Statement of Work, Master Services Agreement, Data Processing Addendum, Non-Disclosure Agreement, or other written agreement between ZenBang and a client. Where such an agreement conflicts with this Privacy Policy concerning Client Data, the written agreement controls.

3. How We Use Information

We may use personal information and Client Data for the following business and commercial purposes:

  • To respond to inquiries, quote requests, and consultation requests;

We may use aggregated or de-identified information for lawful business purposes, including analytics, operational planning, security analysis, and service improvement. We will not attempt to re-identify de-identified information except as permitted by applicable law.

4. Artificial Intelligence and Machine Learning Tools

4.1 Use of AI-Assisted Development Tools

ZenBang may use modern artificial intelligence ("AI"), large language model ("LLM"), code-assistance, automation, testing, documentation, design, analysis, and workflow tools in connection with project scoping, architecture, software development, debugging, quality assurance, documentation, and internal operations.

These tools are intended to help our engineers work efficiently, identify potential issues, improve development workflows, and support the delivery of high-quality client solutions. AI-assisted tools do not replace professional judgment, human engineering review, security review, testing, or client approval processes.

4.2 Client Data and Model-Training Safeguard

ZenBang does not authorize, sell, license, or share Client Data, proprietary code, confidential information, business logic, credentials, personal records, trade secrets, or other private materials submitted to ZenBang for the purpose of training public, foundational, or third-party AI models.

We do not knowingly submit client-owned proprietary materials to open public model-training pools.

4.3 Enterprise Controls and Data Hygiene

When AI-enabled tools are used in connection with Client Data or confidential development work, ZenBang uses commercially reasonable data-governance practices designed to protect confidentiality. Depending on the applicable tool and engagement, these practices may include:

  • Enterprise-tier API or business agreements;
  • Contractual no-training or zero-data-retention commitments;
  • Administrative settings or vendor opt-outs that prohibit model training on submitted content;
  • Restricted-access environments;
  • Data minimization and redaction practices;
  • Least-privilege access controls;
  • Segregation of development environments; and
  • Internal review procedures for the handling of sensitive materials.

No security method can guarantee absolute protection in every circumstance. However, ZenBang maintains policies and technical practices designed to preserve the confidentiality of Client Data and to prevent its use for public or foundational AI-model training.

4.4 Client Instructions and Sensitive Data

Clients should not provide production credentials, regulated data, highly sensitive personal information, or other sensitive materials unless reasonably necessary for the engagement and authorized under the applicable project agreement.

For projects involving regulated data, including protected health information, payment-card data, financial information, biometric data, children's data, or other specially regulated information, ZenBang and the client may need to enter into additional written agreements and implement additional safeguards before such information is provided or processed.

6. How We Disclose Information

6.1 Service Providers and Infrastructure Providers

We may use carefully selected service providers that support our operations, including providers of:

  • Payment processing services, such as Stripe or similar providers;
  • Analytics, monitoring, logging, security, and performance tools;
  • Customer relationship management, accounting, invoicing, and project-management tools;
  • Code repositories, deployment platforms, and software-development infrastructure; and
  • AI-enabled developer tools and APIs configured in accordance with our data-governance practices.

These providers may process personal information only as necessary to provide services to ZenBang or to support an authorized client project, subject to their applicable contractual obligations and privacy practices.

6.2 Professional Advisors and Business Partners

We may disclose information to our attorneys, accountants, insurers, financial institutions, auditors, consultants, and other professional advisors when reasonably necessary for business operations, legal compliance, or protection of our rights.

We may disclose information when we reasonably believe disclosure is necessary to:

  • Comply with applicable law, regulation, legal process, subpoena, or lawful government request;
  • Enforce our agreements;
  • Protect the security, rights, property, safety, or operations of ZenBang, Zenlock Productions LLC, our clients, users, or others;
  • Detect or prevent fraud, misuse, or security incidents; or
  • Establish, exercise, or defend legal claims.

6.4 Business Transfers

If Zenlock Productions LLC is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, information may be disclosed or transferred as part of that transaction, subject to applicable law and appropriate confidentiality protections.

6.5 With Your Direction or Consent

We may disclose information with your direction, authorization, or consent.

7. No Sale or Sharing of Personal Information

ZenBang and Zenlock Productions LLC do not sell personal information for monetary consideration.

ZenBang does not knowingly sell or share personal information as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), for cross-context behavioral advertising.

We do not use Client Data, proprietary code, confidential project materials, or client business information as a product for sale.

8. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

  • Provide and support our services;
  • Maintain project records;
  • Comply with legal, tax, accounting, and recordkeeping obligations;
  • Resolve disputes;
  • Enforce our agreements; and
  • Protect our business, systems, and users.

Retention periods vary based on the type of information, the nature of the relationship, the sensitivity of the data, contractual requirements, and legal obligations.

Unless a written agreement states otherwise, Client Data may be retained during the term of the applicable engagement and for a reasonable period afterward for transition, backup, legal, security, and recordkeeping purposes. Upon written request and subject to applicable law, contract terms, backup limitations, and legitimate business needs, ZenBang will delete or return Client Data in accordance with the applicable agreement.

9. Security and Protection of Client Intellectual Property

ZenBang uses commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information and Client Data from unauthorized access, disclosure, alteration, loss, misuse, or destruction.

Our practices may include, as appropriate:

  • Access controls and least-privilege authorization;
  • Multi-factor authentication where available;
  • Encryption in transit and, where appropriate, at rest;
  • Secure credential-management practices;
  • Environment separation for development, testing, and production;
  • Security monitoring, logging, and incident-response procedures;
  • Confidentiality obligations for personnel and contractors;
  • Vendor review and restricted processor access; and
  • Secure code-review, testing, and deployment practices.

Despite these safeguards, no internet transmission, storage system, or security measure is completely secure. You are responsible for using reasonable measures to protect information you provide to us, including safeguarding your own credentials and promptly notifying us of suspected unauthorized access.

10. International Data Transfers

ZenBang is based in the United States and may process information in the United States and in other countries where ZenBang, Zenlock Productions LLC, our clients, or our service providers operate.

Those jurisdictions may have data-protection laws that differ from the laws of your country or region. Where required by applicable law, ZenBang will implement appropriate safeguards for international transfers of personal data, such as contractual protections, recognized transfer mechanisms, or other lawful measures.

11. Your Privacy Rights
